Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between you ("User," "you," "your") and PolyFire ("Company," "we," "us," "our"), governing your access to and use of the PolyFire platform, including the @poly_fire_bot Telegram bot, the website located at polyfire.co, all related APIs, smart contract interactions, and any other products or services offered by PolyFire (collectively, the "Service"). By accessing or using the Service in any manner — including initiating a conversation with the bot, clicking "Start," depositing funds, executing a trade, or simply reading content provided through the Service — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, or if you cannot make the representations and warranties set forth herein, you must immediately cease all use of the Service and must not initiate or continue any transactions through the platform. Your continued use of the Service following any modification to these Terms constitutes your binding acceptance of those modifications. We strongly encourage you to review these Terms periodically.

These Terms incorporate by reference our Privacy Policy and any additional guidelines, rules, or policies we make available within the Service. In the event of a conflict between these Terms and any supplemental policy, these Terms shall control unless the supplemental policy explicitly states otherwise. Nothing in these Terms shall be construed to create a partnership, joint venture, employment relationship, or agency relationship between you and PolyFire.

You represent that you have the legal capacity to enter into binding contracts under the laws of your jurisdiction. If you are accessing the Service on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms, and references to "you" shall include both you individually and that entity. PolyFire reserves the right to require verification of such authority at any time.

2. Eligibility

You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older. If we discover or have reason to believe that a user is under the age of 18, we will immediately terminate that user's access to the Service. PolyFire bears no liability for any harm arising from a minor's use of the Service obtained through misrepresentation of age.

The Service is not available to residents of, or persons physically located in, jurisdictions where participation in prediction markets, cryptocurrency trading, or similar activities is prohibited or restricted by applicable law. This includes, but is not limited to, the United States of America and its territories, and any jurisdiction where the Service would constitute an unlicensed money transmission, securities offering, or gambling activity. You are solely responsible for determining whether your use of the Service is lawful in your jurisdiction. PolyFire makes no representation that the Service is appropriate or available for use in any particular location. Nothing in these Terms constitutes legal or regulatory advice regarding the legality of the Service in your jurisdiction.

By using the Service, you represent and warrant that: (a) you are not a citizen or resident of a jurisdiction that prohibits your use of the Service; (b) you are not subject to any sanctions administered or enforced by the United States Office of Foreign Assets Control ("OFAC"), the United Nations Security Council, the European Union, His Majesty's Treasury of the United Kingdom, or any other applicable governmental authority; (c) you are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive U.S. sanctions, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine; (d) your use of the Service will not violate any laws applicable to you, including without limitation anti-money laundering laws, anti-bribery laws, and sanctions regulations; and (e) you are not on any government prohibited, denied, or sanctioned parties list.

PolyFire reserves the right, at its sole discretion, to refuse service to any person or entity for any reason, including but not limited to suspected violation of these eligibility requirements. We may implement technical measures to block access from certain jurisdictions without prior notice. Any breach of these eligibility representations is grounds for immediate termination of your account and forfeiture of any referral commissions.

3. Account Registration and Security

Access to the Service is provided through the Telegram messaging platform via @poly_fire_bot. Your "account" with PolyFire is tied to your Telegram user identity and the blockchain wallet automatically generated for you upon first use of the Service. You are responsible for maintaining the security of your Telegram account, including your Telegram password, two-factor authentication settings, and any linked devices. PolyFire is not responsible for any loss, damage, or unauthorized activity resulting from your failure to maintain adequate Telegram account security.

You agree to notify PolyFire immediately via the /support command or by contacting @polyfireco on Telegram if you suspect any unauthorized access to your Telegram account or your associated PolyFire wallet. PolyFire cannot reverse, cancel, or recover funds from any blockchain transaction that has been confirmed on the Polygon network, regardless of whether such transaction was authorized by you. If your Telegram account is compromised and an unauthorized party executes trades or withdrawals through the Service, PolyFire bears no liability for resulting losses.

You agree to provide accurate, current, and complete information in connection with your use of the Service, and to update such information as necessary to keep it accurate. You may not use a false identity, impersonate any person or entity, or misrepresent your affiliation with any person or entity. PolyFire reserves the right to suspend or terminate accounts that we believe contain false or misleading information.

You acknowledge that PolyFire does not control the Telegram platform and is not responsible for any changes, restrictions, disruptions, or discontinuation of Telegram services that may affect your ability to access the Service. If Telegram restricts or terminates your access to the @poly_fire_bot for any reason, PolyFire is not obligated to provide an alternative access method, though we may choose to do so at our sole discretion. Your blockchain wallet and any funds it contains remain accessible to you independent of Telegram access, provided you have exported and securely stored your private key.

4. Description of Service

PolyFire is a non-custodial cryptocurrency trading interface delivered via the Telegram messaging platform. The Service enables users to interact with Polymarket, a decentralized prediction market platform operating on the Polygon blockchain, and related decentralized finance protocols. PolyFire is an independent product and is not affiliated with, endorsed by, or sponsored by Polymarket, Polygon, or any other third-party platform or protocol referenced in connection with the Service.

The Service includes, without limitation, the following features: (a) manual trading — the ability to purchase and sell outcome shares on Polymarket prediction markets using the Polymarket CLOB (Central Limit Order Book); (b) copy trading — the ability to automatically mirror trades executed by designated "Smart Wallets," which are external Polygon wallet addresses identified by the platform as high-performing Polymarket traders; (c) market intelligence — curated data, signals, and analytics about prediction market activity; (d) token swapping — the ability to swap between USDC and USDC.e (bridged USDC) within the Polygon ecosystem; (e) stablecoin bridging; (f) withdrawals to external wallet addresses; and (g) a referral program that allows users to earn commissions on trading fees generated by referred users.

The Service is provided as a convenience interface only. PolyFire does not operate the underlying prediction markets, smart contracts, or blockchain infrastructure. Trades are executed on-chain via smart contract interactions with the Polymarket CLOB Exchange (contract address: 0x4bFb41d5B3570DeFd03C39a9A4D8dE6Bd8B8982E) and the Negative Risk Adapter (contract address: 0xd91E80cF2E7be2e162c6513ceD06f1dD0dA35296). PolyFire does not control these contracts and cannot modify, pause, or reverse their behavior.

The features, functionality, and availability of the Service may change at any time without notice. PolyFire may add, modify, or remove features at its sole discretion. We may impose usage limits, rate limits, or other restrictions on the Service at any time. The Service is provided "as is" and "as available" without warranty of any kind, as described more fully in Section 21 of these Terms. PolyFire does not guarantee that any particular feature will be available at any given time, that execution of any particular trade will succeed, or that any displayed market data is accurate or current.

PolyFire provides market data, signals, and analytics for informational purposes only. Nothing provided through the Service constitutes financial advice, investment advice, trading advice, or any other form of professional advice. See Section 14 for a full disclaimer regarding the non-advisory nature of the Service.

5. Non-Custodial Wallet Service

PolyFire operates on a non-custodial model. When you first use the Service, PolyFire automatically generates a unique Polygon blockchain wallet address for your account. You — and only you — are the owner of this wallet and all assets contained therein. PolyFire does not hold, custody, control, or take title to any cryptocurrency or other digital assets associated with your wallet at any time. PolyFire is not a money transmitter, custodian, exchange, or financial institution with respect to your wallet or its contents.

Your wallet's private key is generated and encrypted using AES-256-GCM encryption before being stored in PolyFire's database. The encryption key is derived from service-controlled secrets. PolyFire decrypts your private key only transiently, in memory, and solely for the purpose of signing blockchain transactions that you have explicitly authorized through the bot interface. The decrypted key is never logged, stored in plaintext, transmitted over the network, or retained after the signing operation is complete. While we take significant technical measures to protect your encrypted private key, no encryption system is perfectly secure, and you acknowledge this residual risk.

Because the Service operates on a non-custodial basis, PolyFire cannot: freeze or reverse transactions once submitted to the blockchain; recover funds sent to incorrect addresses; undo trades you have authorized; prevent withdrawals if your Telegram account is compromised; or access your funds for any purpose without your explicit instruction. These limitations are fundamental to the non-custodial model and are not bugs or service failures.

You acknowledge that by using the Service, you are interacting directly with blockchain smart contracts and that all transactions are irreversible once confirmed. PolyFire's role is limited to providing an interface for you to authorize and execute these transactions. The Company has no ability to modify, reverse, or dispute confirmed blockchain transactions on your behalf.

6. Private Key Responsibility and Recovery

You may export your wallet's private key at any time using the /exportkey command within the bot. We strongly recommend that you export and securely store your private key as soon as you begin depositing meaningful funds into the Service. Your private key enables you to access your wallet and its contents from any compatible Polygon wallet application, completely independent of PolyFire or the Telegram platform. If you export your private key and import it into another wallet (such as MetaMask, Rabby, or any other EVM-compatible wallet application), you can access your funds directly without relying on PolyFire.

If you lose access to your Telegram account — whether due to a forgotten password, device loss, SIM swap, account ban, or any other reason — you will lose the ability to access the Service through the bot. PolyFire does not maintain alternative login methods, seed phrases, or recovery codes. If you have previously exported your private key and stored it securely, you can still access your funds directly via any compatible wallet application. If you have not exported your private key and you lose Telegram access, your funds may be permanently inaccessible. PolyFire bears absolutely no responsibility or liability for loss of funds resulting from failure to export and securely store your private key.

You are solely responsible for the secure storage and confidentiality of your exported private key. Anyone who obtains your private key gains complete, irrevocable access to all assets in your wallet. Never share your private key with anyone, including PolyFire support personnel — no legitimate PolyFire employee or representative will ever ask for your private key. If you receive any communication requesting your private key, treat it as a phishing attempt and report it immediately.

In the event that PolyFire ceases operations, is acquired, or otherwise discontinues the Service, your blockchain wallet and its contents remain fully accessible to you via your exported private key, as the wallet exists on the public Polygon blockchain independent of PolyFire's infrastructure. PolyFire strongly recommends that all users export their private keys as a precautionary measure regardless of their level of engagement with the platform. Failure to do so represents a material risk that is entirely within your control to mitigate.

7. Trading and Order Execution

All orders executed through the Service are submitted as FOK (Fill-Or-Kill) market orders to the Polymarket CLOB. A Fill-Or-Kill order is an order that must be executed in its entirety immediately upon submission or, if it cannot be fully filled at the time of submission, is automatically cancelled in full. There are no partial fills, no pending orders, no limit orders, and no open order states. An order either executes completely at the available market price, or it fails completely without any change to your balance. You acknowledge and accept that this order type is the only execution method available through the Service.

The minimum order size enforced by the Polymarket CLOB is one dollar ($1.00 USD). PolyFire recommends a minimum order size of five dollars ($5.00 USD) for practical trading, as very small orders may result in disproportionately high fee and gas cost relative to position size. Orders below $1.00 will be rejected. PolyFire is not responsible if Polymarket modifies its minimum order requirements, and you acknowledge that such requirements may change without notice from PolyFire.

Prediction market prices are highly volatile and can change rapidly between the time you initiate an order and the time it is submitted to the blockchain. The price displayed to you in the bot interface at the time you confirm an order may differ from the actual execution price. This difference, commonly referred to as "slippage," can be positive or negative and may be material. PolyFire makes no guarantee that any order will execute at or near any quoted or displayed price. You accept full responsibility for any slippage that occurs during order execution.

Gas fees on the Polygon network are required for all on-chain transactions, including trades, approvals, swaps, and withdrawals. The Service applies a gas price cap of 1,000 gwei per gas unit. If network congestion causes gas prices to exceed this cap, trading and other on-chain operations will be suspended until gas prices return to an acceptable level. PolyFire is not responsible for losses arising from the inability to execute trades during periods of network congestion. POL (the native Polygon token) is required in your wallet to pay gas fees; if your POL balance is insufficient, transactions will fail.

Before executing trades on the Polymarket CLOB, your wallet must have an active approval for the CTF Exchange contract at address 0x4bFb41d5B3570DeFd03C39a9A4D8dE6Bd8B8982E. PolyFire will prompt you to provide this approval when necessary. This approval authorizes the smart contract to transfer conditional tokens on your behalf when settling trades. You acknowledge that granting smart contract approvals carries inherent risk, as described in Section 13 of these Terms.

Certain Polymarket markets operate under a "Negative Risk" or "negRisk" model, which may impose additional restrictions on sell orders. Specifically, you may be unable to sell outcome shares in negRisk markets if the total value of your position in that market is less than $1.00. These restrictions are imposed by the Polymarket protocol, not by PolyFire, and PolyFire cannot override them. You acknowledge that you may be temporarily or permanently unable to exit certain positions due to these protocol-level restrictions.

8. Copy Trading Terms

PolyFire's copy trading feature allows you to designate one or more external Polygon wallet addresses as "Smart Wallets" to follow. When a Smart Wallet you follow executes a new trade on Polymarket, the Service will automatically attempt to mirror that trade in your wallet, scaled to the per-wallet allocation amount you have configured. Copy trading executes new trades only — it does not replicate historical positions, close existing positions on your behalf, or automatically exit copied trades. Once a copied trade is in your wallet, it is your position to manage.

Smart Wallets are external, unaffiliated third-party wallet addresses. PolyFire does not control, compensate, employ, or have any contractual relationship with the owners of Smart Wallets. The designation of a wallet as a "Smart Wallet" or "top trader" is based solely on historical on-chain performance data and does not constitute an endorsement, recommendation, or guarantee of future performance. Past performance of any Smart Wallet is not indicative of future results. Smart Wallet owners may change their trading strategies, stop trading, trade in ways that are inappropriate for your situation, or engage in behavior that negatively impacts copied trades at any time without notice.

Copy trading is subject to execution risk. Due to timing differences between when a Smart Wallet executes a trade and when your copied trade is submitted to the blockchain, your copied trade may execute at a materially different price, or may fail to execute entirely due to market movement, insufficient liquidity, gas congestion, or other factors. PolyFire does not guarantee that any copy trade will execute, and a failed copy trade does not entitle you to any compensation or refund.

You are solely responsible for configuring copy trading parameters, including per-wallet allocation amounts and which Smart Wallets to follow. PolyFire is not responsible for losses arising from: following Smart Wallets that perform poorly; allocation amounts that result in overexposure; trades that execute at unfavorable prices due to slippage; or markets that resolve against copied positions. Copy trading involves substantial risk and may result in the loss of all funds allocated to the feature.

PolyFire reserves the right to add, remove, or modify the list of available Smart Wallets at any time without notice. A Smart Wallet may be removed from the platform if we determine that its trading activity is suspicious, manipulative, or otherwise not in the interest of users. Removal of a Smart Wallet will automatically stop future copy trades from that wallet, but will not affect positions you already hold. PolyFire bears no liability for any losses incurred prior to or following the removal of a Smart Wallet from the platform.

9. Fee Schedule

PolyFire charges a flat fee of one percent (1%) on the notional value of all executed trades, including both manual trades and copy trades, and including both BUY and SELL orders. This fee is charged only upon successful execution of a trade — failed orders, cancelled orders, and rejected orders incur no fee. PolyFire does not charge fees on token swaps (USDC to USDC.e or vice versa), stablecoin bridging operations, or withdrawals. There are no subscription fees, monthly fees, deposit fees, or hidden charges of any kind associated with the Service.

The fee structure is additive: the 1% fee is added on top of the trade amount you authorize. For example, if you execute a BUY order for $100.00 worth of outcome shares, your wallet will be debited $101.00 — $100.00 for the trade and $1.00 as the PolyFire service fee. If you execute a SELL order that generates $50.00 in proceeds, the net amount credited to your wallet will be $49.50 after deduction of the $0.50 service fee. Gas fees (paid in POL) are charged separately by the Polygon network and are not included in the PolyFire service fee.

All service fees collected by PolyFire are transferred to the platform Revenue Wallet at Polygon address 0x7bCE61eb83D22F1Ac10b18e2F34638cA1a5a7622. Fee collection occurs on-chain at the time of trade execution. You acknowledge that all fee transactions are publicly visible on the Polygon blockchain. Referral commissions (as described in Section 10) are distributed from this Revenue Wallet to qualifying referrers.

PolyFire reserves the right to modify the fee schedule at any time, including changing the percentage rate, introducing fees for currently free operations (such as swaps or withdrawals), or eliminating fees for currently charged operations. Any material change to the fee schedule will be communicated to users with at least fourteen (14) days' notice via announcement through the bot or the PolyFire website at polyfire.co. Your continued use of the Service after the effective date of a fee change constitutes your acceptance of the new fee structure. If you disagree with a fee change, your sole remedy is to cease using the Service.

You acknowledge that fees charged by PolyFire are separate from and in addition to any fees charged by Polymarket, the Polygon network (gas), or any other third-party protocol involved in the execution of your transactions. PolyFire is not responsible for and cannot control third-party fees. Third-party fees may change without notice to PolyFire or to you.

10. Referral Program Terms

PolyFire operates a three-tier affiliate referral program that allows users to earn commissions based on trading fees generated by users they have referred to the platform. When you share your unique referral link or code and a new user registers and trades through that link, you become that user's Level 1 (direct) referrer. The referral relationship is established at the time of account creation and is permanent — it cannot be changed, transferred, or overridden after the fact.

The referral commission structure is as follows:

  • Level 1 (direct referral): 15% of the PolyFire service fee generated by your direct referral on each trade
  • Level 2 (your referral's referrals): 10% of the PolyFire service fee generated by second-degree referrals on each trade
  • Level 3 (third-degree referrals): 5% of the PolyFire service fee generated by third-degree referrals on each trade

To illustrate: if a user you directly referred (Level 1) executes a $100.00 trade, PolyFire collects a $1.00 fee. Of that $1.00 fee, $0.15 (15%) is credited to you as the Level 1 referrer. If that same user referred another user (your Level 2) who also executes a $100.00 trade, $0.10 (10%) of the $1.00 fee is credited to you. The total referral commission distributed across all three tiers represents 30% of each collected fee (15% + 10% + 5%), with the remaining 70% retained by PolyFire as platform revenue. Commissions are calculated on PolyFire's service fee only, not on trade notional values or gas costs.

Referral commissions are credited automatically to your PolyFire trading wallet in USDC.e, typically within a short time after the qualifying trade is confirmed on-chain. PolyFire does not guarantee any minimum payment amount or payment timeline. Commissions below a de minimis threshold may be held and aggregated before distribution. You are responsible for any tax obligations arising from referral commissions you receive; see Section 38 for additional information.

PolyFire reserves the right to modify, suspend, or terminate the referral program in its entirety at any time, for any reason, with or without notice. Any earned but unpaid commissions at the time of program termination will be paid out within a reasonable period following termination; however, PolyFire makes no guarantees regarding commissions that were conditional upon future trading activity by referrals. Participation in the referral program is a privilege, not a right, and PolyFire's determination regarding commission calculations is final.

11. Referral Program Restrictions and Anti-Abuse

The referral program is intended to reward genuine user acquisition. PolyFire maintains a strict zero-tolerance policy for referral abuse, manipulation, or fraud. Any attempt to game, exploit, or abuse the referral program will result in immediate and permanent termination of all referral commissions, forfeiture of any accrued but unpaid commissions, and termination of your account. PolyFire reserves the right to claw back commissions previously paid if we determine they were earned through abusive means.

The following activities constitute referral abuse and are strictly prohibited:

  • Self-referral: creating secondary accounts to refer yourself and earn commissions on your own trading activity
  • Wash trading: executing trades between controlled accounts for the purpose of generating referral commissions without genuine market exposure
  • Sybil attacks: creating multiple Telegram accounts or wallets to artificially inflate referral networks
  • Incentivizing referrals through prohibited means, including paying referees from your own funds to engage in trading activity
  • Misrepresenting the Service, its fees, returns, risks, or features in referral marketing materials
  • Distributing referral links through unsolicited communications (spam)
  • Falsifying or manipulating referral tracking data
  • Using bots, scripts, or automated tools to generate fake referral activity
  • Any other conduct that PolyFire, in its sole discretion, determines to be inconsistent with the spirit and intent of the referral program

PolyFire employs ongoing monitoring to detect referral abuse, including on-chain analysis, behavioral pattern detection, and manual review. We reserve the right to withhold commissions pending investigation if suspicious activity is detected, without any obligation to disclose the specific basis for our suspicion. Our determination as to what constitutes referral abuse is final and not subject to appeal.

You may not make any representations or warranties about PolyFire's referral program to third parties that are inconsistent with the terms described herein. You may not guarantee returns, imply that the referral program constitutes an investment, or market the referral program in any way that could subject PolyFire to regulatory liability. PolyFire reserves the right to require you to remove or modify referral marketing materials that we believe are inaccurate, misleading, or legally problematic.

12. Token Types and Blockchain Transactions

The Service involves multiple token types on the Polygon blockchain, each with distinct characteristics and use cases. Understanding the distinction between these tokens is your responsibility. The primary tokens used within the Service are:

  • USDC (Native): The USD Coin issued natively on Polygon by Circle Financial. Used for deposits to and withdrawals from your PolyFire wallet. USDC is the token you receive when you withdraw funds from the platform.
  • USDC.e (Bridged): A bridged version of USDC, created by locking native USDC and minting a corresponding representation on Polygon via a bridge protocol. USDC.e is the token required by the Polymarket CLOB for trading. Your trading balance is denominated in USDC.e.
  • POL: The native gas token of the Polygon blockchain, formerly known as MATIC. Required in small quantities to pay transaction fees (gas) for all on-chain operations, including trades, swaps, approvals, and withdrawals. POL must be obtained separately and maintained in your wallet.

Because Polymarket requires USDC.e for trading, you must swap your native USDC to USDC.e before executing trades. The Service facilitates this swap. Token swaps are free under the current fee schedule. However, swaps are on-chain transactions subject to market rates, bridge protocols, and smart contract interactions that are outside PolyFire's control. PolyFire does not guarantee any particular swap rate or that swaps will execute at a specific price. Bridge and swap protocols carry their own risks, including smart contract risk, bridge exploits, and liquidity constraints.

All transactions executed through the Service are recorded permanently and immutably on the Polygon blockchain. Once a transaction is confirmed on-chain, it cannot be reversed, cancelled, or modified by PolyFire or by you. Blockchain transactions are public and can be viewed by anyone with access to a Polygon blockchain explorer. If you send funds to an incorrect address, PolyFire cannot recover them. You are solely responsible for verifying all wallet addresses before initiating withdrawals or transfers.

Cryptocurrency tokens, including USDC, USDC.e, and POL, carry inherent risks including but not limited to de-pegging (for stablecoins), regulatory action, bridge exploits, smart contract vulnerabilities, and loss of value. The term "stablecoin" does not guarantee a stable value, and PolyFire makes no representation that USDC or USDC.e will maintain any particular value at any time. You acknowledge these risks and agree that PolyFire is not responsible for any losses arising from token-related risks.

13. Smart Contract Risks

The Service relies on smart contracts deployed on the Polygon blockchain, including but not limited to the Polymarket CTF Exchange (0x4bFb41d5B3570DeFd03C39a9A4D8dE6Bd8B8982E), the Negative Risk Adapter (0xd91E80cF2E7be2e162c6513ceD06f1dD0dA35296), and various token swap and bridge contracts. Smart contracts are self-executing programs that operate autonomously based on their coded logic. They cannot be modified, paused, or overridden by PolyFire once deployed. You acknowledge that all interactions with these smart contracts carry significant risk.

Smart contract risks include, without limitation: (a) bugs, errors, or vulnerabilities in the smart contract code that could result in loss of funds; (b) exploitation of vulnerabilities by malicious actors; (c) unexpected interactions between smart contracts; (d) oracle failures that cause incorrect market resolution; (e) front-running and MEV (Miner Extractable Value) attacks that negatively affect execution prices; (f) governance changes to smart contract protocols that alter their behavior; and (g) regulatory actions that cause smart contract protocols to cease operation. Any of these events could result in partial or total loss of funds you have deployed through the Service, and PolyFire bears no liability for such losses.

When you grant token approvals to smart contracts (such as the CTF Exchange approval required for Polymarket trading), you are authorizing those contracts to transfer tokens from your wallet up to the approved amount. PolyFire recommends that you understand the implications of any smart contract approval before granting it. While PolyFire initiates the approval transaction on your behalf, the approval is a blockchain-level authorization that persists independently of PolyFire's systems. You can revoke approvals at any time using any compatible wallet application.

PolyFire does not audit the smart contracts of third-party protocols used in connection with the Service. The fact that PolyFire integrates with a particular protocol or smart contract does not constitute an endorsement of the security, reliability, or legitimacy of that contract. You should independently assess the risks of any smart contract with which you interact, and you acknowledge that PolyFire's integration of a third-party protocol creates no warranty or guarantee regarding that protocol's safety.

14. No Financial, Investment, or Tax Advice

Nothing in the Service, including market data, signals, analytics, Smart Wallet designations, AI-generated insights, bot messages, or any other content provided through any PolyFire channel, constitutes financial advice, investment advice, trading advice, securities advice, tax advice, legal advice, or any other form of professional advice. PolyFire is not a registered investment advisor, broker-dealer, financial planner, tax professional, or legal counsel, and the Service is not designed or intended to substitute for the advice of such professionals.

Any information provided through the Service regarding markets, prices, outcomes, probabilities, Smart Wallet performance, or trading signals is provided solely for informational and entertainment purposes. Such information should not be construed as a recommendation to buy, sell, or hold any particular position. Market predictions are inherently uncertain, and all prediction market outcomes are binary — you may lose your entire investment on any given position. You should conduct your own independent research and consult with qualified financial and legal advisors before making any investment decisions.

You acknowledge that participation in prediction markets involves speculative risk of the highest order, that markets can and do resolve in unexpected ways, that you may lose all funds deployed through the Service, and that past performance of any market, wallet, or signal is no guarantee of future results. PolyFire does not guarantee any return on any investment made through the Service and explicitly disclaims any representation, whether express or implied, that the Service will generate profits.

The tax treatment of prediction market winnings, losses, referral commissions, and cryptocurrency transactions varies significantly by jurisdiction and individual circumstance. PolyFire does not provide tax advice and strongly recommends that you consult a qualified tax professional in your jurisdiction to understand your tax obligations arising from use of the Service. You are solely responsible for all tax filings and payments related to your use of the Service.

15. Risk Disclosures

USE OF THE SERVICE INVOLVES SUBSTANTIAL RISK OF LOSS. YOU SHOULD CAREFULLY CONSIDER WHETHER TRADING ON PREDICTION MARKETS IS APPROPRIATE FOR YOU IN LIGHT OF YOUR FINANCIAL SITUATION, OBJECTIVES, AND RISK TOLERANCE. THE FOLLOWING IS A NON-EXHAUSTIVE LIST OF MATERIAL RISKS ASSOCIATED WITH THE SERVICE. THIS LIST IS NOT INTENDED TO BE COMPREHENSIVE, AND ADDITIONAL RISKS MAY EXIST THAT ARE NOT DESCRIBED HERE.

Market Risk. Prediction market prices are highly volatile and can move rapidly and unpredictably. Outcomes that appear highly probable may resolve against expectations. All positions carry binary resolution risk — on any given market, you may lose your entire position. There is no stop-loss mechanism in prediction markets, and positions may move to near-zero value without an exit opportunity at a meaningful price.

Liquidity Risk. Many prediction markets have limited liquidity. You may be unable to exit a position at any price, or only at a price significantly below the last traded price. FOK orders ensure you are never partially filled at a bad price, but thin order books mean your orders may frequently fail to execute. During high-volatility events, liquidity can evaporate entirely.

Smart Contract Risk. As described in Section 13, the smart contracts underlying the Service may contain bugs or vulnerabilities that could result in loss of funds. No smart contract can be considered perfectly secure. A single vulnerability could result in the total loss of all funds held by the protocol.

Blockchain and Network Risk. The Polygon blockchain may experience outages, forks, reorganizations, congestion, or other technical failures that disrupt your ability to execute transactions. Gas prices may spike to levels exceeding the 1,000 gwei cap, preventing trade execution during critical moments. Transactions may be delayed, dropped, or fail in ways outside PolyFire's control.

Regulatory Risk. The regulatory status of prediction markets and cryptocurrency activities is uncertain and evolving across jurisdictions globally. Regulatory actions could restrict, prohibit, or fundamentally alter the Service, require PolyFire to cease operations entirely, or cause Polymarket or other underlying protocols to shut down. Changes in law or regulation could render your positions illiquid or worthless.

Counterparty Risk. Polymarket and other third-party protocols integrated with the Service may fail, be hacked, cease operations, or make decisions that adversely affect your positions. PolyFire has no contractual relationship with Polymarket and cannot compel any particular behavior from third-party protocols. Market resolution disputes on Polymarket are resolved by Polymarket's UMA oracle system, which is entirely outside PolyFire's control or influence.

Technology and Operational Risk. PolyFire's systems may experience bugs, outages, downtime, security breaches, or failures that prevent you from accessing the Service or executing trades. The Service depends on third-party infrastructure including Telegram, cloud providers, RPC nodes, and data providers, any of which may fail. PolyFire is not responsible for losses arising from technological failures, whether within PolyFire's systems or in third-party infrastructure.

Copy Trading Risk. Automatically copying trades from Smart Wallets carries additional risks beyond manual trading, including execution timing risk, the risk that Smart Wallet owners change their strategies, and the risk that a strategy that was historically profitable ceases to be profitable without warning.

Currency and Stablecoin Risk. USDC and USDC.e are stablecoins intended to maintain a 1:1 peg with the US Dollar, but this peg is not guaranteed. A failure of Circle Financial, a regulatory action, or a bank run on the underlying reserves could cause USDC to depeg significantly. The bridged nature of USDC.e introduces additional risk associated with the bridge protocol.

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE RISK DISCLOSURES, THAT THESE RISKS ARE REAL AND MATERIAL, AND THAT YOU ARE PREPARED TO ACCEPT THESE RISKS, INCLUDING THE POSSIBILITY OF TOTAL LOSS OF ALL FUNDS YOU DEPLOY THROUGH THE SERVICE.

16. User Responsibilities

You are solely responsible for all activity that occurs through your Telegram account and associated PolyFire wallet, whether or not you personally authorized such activity. You must take all reasonable precautions to maintain the security of your Telegram account and your exported private key. You must immediately notify PolyFire if you believe your account has been compromised, though you acknowledge that PolyFire cannot reverse confirmed blockchain transactions.

You are responsible for determining whether use of the Service is legal in your jurisdiction before accessing it. You must comply with all applicable laws and regulations in connection with your use of the Service, including anti-money laundering laws, tax laws, securities laws, and regulations governing prediction markets and cryptocurrency activities. You agree to cooperate with any government investigation regarding your use of the Service and to comply with any applicable reporting obligations.

You are responsible for maintaining sufficient POL in your wallet to cover gas fees for transactions you wish to execute. Insufficient gas will cause transactions to fail, and PolyFire is not responsible for any consequences of failed transactions due to insufficient gas. You should monitor your POL balance regularly and replenish it as needed.

You are responsible for verifying all transaction details, including recipient addresses, trade amounts, token types, and market selections, before authorizing any transaction through the Service. PolyFire is not responsible for errors in transaction details that you have reviewed and authorized. You should never rely solely on information displayed in the bot interface without independently verifying critical details, particularly for large transactions.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to launder money, evade taxes, circumvent sanctions, engage in market manipulation, or facilitate any other illegal activity. You agree to use the Service only in good faith and in a manner consistent with its intended purpose as a trading interface for legitimate prediction market participation.

17. Prohibited Conduct

You agree that you will not, and will not attempt to, engage in any of the following prohibited activities in connection with your use of the Service. Engaging in prohibited conduct may result in immediate termination of your account, forfeiture of any accrued commissions, reporting to law enforcement or regulatory authorities, and legal action by PolyFire to recover damages.

  • Violating any applicable law, regulation, or third-party right in connection with your use of the Service
  • Using the Service to launder money, finance terrorism, evade sanctions, or engage in any other financial crime
  • Engaging in market manipulation, wash trading, spoofing, layering, or any other manipulative trading practice
  • Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of any component of the Service
  • Using bots, scrapers, crawlers, scripts, or automated tools to access or interact with the Service in an unauthorized manner
  • Attempting to gain unauthorized access to PolyFire systems, other users' accounts, or the Service's infrastructure
  • Interfering with or disrupting the Service, including transmitting viruses, malware, or other harmful code
  • Impersonating PolyFire, PolyFire employees, or other users
  • Using the Service to transmit spam, unsolicited messages, or chain letters
  • Violating the intellectual property rights of PolyFire or any third party
  • Exploiting or attempting to exploit vulnerabilities in the Service, smart contracts, or third-party protocols for personal gain
  • Using the Service in any jurisdiction where it is prohibited by applicable law
  • Facilitating or enabling any third party to engage in any of the foregoing prohibited activities
  • Engaging in any conduct that could expose PolyFire to regulatory action, civil liability, or reputational harm

PolyFire reserves the right to investigate any suspected violation of these prohibitions and to take any action we deem appropriate, including cooperation with law enforcement. You agree to cooperate with PolyFire's investigation of suspected prohibited conduct to the extent legally permissible. PolyFire's failure to take action in response to a particular prohibited activity does not constitute a waiver of our right to take action in the future.

18. Intellectual Property

The Service, including all software, algorithms, databases, interfaces, designs, text, graphics, logos, marks, and other content (collectively, "PolyFire Content"), is the proprietary property of PolyFire and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret law. These Terms do not grant you any ownership interest in the Service or PolyFire Content, and all rights not expressly granted herein are reserved by PolyFire.

Subject to your compliance with these Terms, PolyFire grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial trading and related purposes as described herein. You may not sublicense, sell, resell, transfer, assign, or otherwise exploit for commercial purposes this license or the Service. You may not modify, copy, reproduce, republish, or distribute any PolyFire Content without express written permission from PolyFire.

PolyFire and the PolyFire logo are trademarks of PolyFire. You may not use these trademarks without prior written permission from PolyFire. You may not use any metatags or other hidden text utilizing PolyFire's name or trademarks without prior written permission. Unauthorized use of PolyFire trademarks may constitute trademark infringement and unfair competition in violation of applicable law.

If you believe that any content on or accessible through the Service infringes your intellectual property rights, please contact us at the information provided in Section 40. PolyFire will investigate valid infringement claims and respond as required by applicable law. Repeated infringement of third-party intellectual property rights using the Service is grounds for account termination.

19. Third-Party Services and Integrations

The Service integrates with, depends upon, or otherwise interacts with numerous third-party services, platforms, protocols, and infrastructure providers, including without limitation: Telegram (messaging infrastructure), Polymarket (prediction market protocol), Polygon (blockchain network), Polymarket CLOB (order matching and execution), token bridge and swap protocols, blockchain RPC node providers, and various data and analytics services. PolyFire is not affiliated with, controlled by, or responsible for the actions of any of these third parties.

Your use of third-party services in connection with the Service is governed by the respective terms of service and privacy policies of those third parties. PolyFire is not responsible for and does not endorse any third-party service, and your dealings with third-party services are solely between you and that third party. PolyFire is not responsible for any loss or damage arising from your use of third-party services, including but not limited to Polymarket market resolutions, Polygon network outages, Telegram platform changes, or bridge protocol failures.

Polymarket operates its own terms of service, dispute resolution mechanisms, and market resolution procedures that are entirely independent of PolyFire. PolyFire has no ability to influence how Polymarket resolves markets, handles disputes, or operates its platform. If you disagree with a Polymarket market resolution, your recourse is with Polymarket, not PolyFire. PolyFire is not a counterparty to any prediction market trade and does not take positions in any market.

The Service may contain links to third-party websites, applications, or resources. These links are provided for convenience only and do not constitute an endorsement by PolyFire. PolyFire has no control over the content, policies, or practices of linked third-party sites and accepts no responsibility for them. You access third-party links at your own risk.

20. Service Availability and Interruptions

PolyFire does not guarantee that the Service will be available at any particular time or on a continuous basis. The Service may be interrupted for scheduled maintenance, unscheduled outages, technical failures, security incidents, upgrades, or any other reason at PolyFire's discretion. PolyFire will use commercially reasonable efforts to provide advance notice of scheduled maintenance windows, but is not obligated to do so and may take the Service offline immediately in response to emergencies or security threats.

Interruptions to the Service may prevent you from monitoring positions, executing trades, responding to market movements, or accessing your wallet through the bot interface. PolyFire is not liable for any losses arising from Service interruptions, regardless of their cause or duration. During Service interruptions, your blockchain wallet and its assets remain intact and accessible via any compatible Polygon wallet application if you have exported your private key.

The Service depends on third-party infrastructure including Telegram, cloud hosting providers, blockchain nodes, and data providers. Failures in any of these third-party systems can affect the availability and performance of the Service. PolyFire is not responsible for downtime or degraded performance caused by third-party infrastructure failures. PolyFire has no control over Telegram's availability and cannot guarantee access to the bot at any time.

PolyFire reserves the right to implement rate limiting, usage caps, or other technical restrictions on your use of the Service at any time without prior notice. These restrictions may be implemented to protect the integrity of the Service, prevent abuse, comply with legal requirements, or manage system capacity. PolyFire is not responsible for any losses arising from such restrictions.

21. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POLYFIRE EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE OF TRADE, OR COURSE OF PERFORMANCE.

WITHOUT LIMITING THE FOREGOING, POLYFIRE MAKES NO WARRANTY THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (C) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (D) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED; (E) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (F) ANY DISPLAYED PRICES, MARKET DATA, SIGNALS, OR OTHER INFORMATION IS ACCURATE, COMPLETE, RELIABLE, OR CURRENT; (G) ANY TRADE WILL EXECUTE AT THE DISPLAYED PRICE OR AT ALL; OR (H) COPY TRADING OR ANY OTHER FEATURE WILL GENERATE PROFITS OR PREVENT LOSSES.

POLYFIRE DOES NOT WARRANT THE ACTIONS, SECURITY, OR RELIABILITY OF ANY THIRD-PARTY SERVICE, PROTOCOL, SMART CONTRACT, OR INFRASTRUCTURE PROVIDER USED IN CONNECTION WITH THE SERVICE. ANY CONTENT OBTAINED THROUGH THE SERVICE IS OBTAINED AT YOUR OWN RISK, AND POLYFIRE IS NOT RESPONSIBLE FOR ANY DAMAGE CAUSED BY YOUR RELIANCE ON SUCH CONTENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

22. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL POLYFIRE, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF BUSINESS OPPORTUNITIES, TRADING LOSSES, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF POLYFIRE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL POLYFIRE'S TOTAL CUMULATIVE LIABILITY TO YOU FROM ALL CAUSES OF ACTION AND ALL THEORIES OF LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF SERVICE FEES YOU ACTUALLY PAID TO POLYFIRE IN THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD). THE PARTIES ACKNOWLEDGE THAT THE LIMITATION OF LIABILITY IN THIS SECTION IS AN ESSENTIAL ELEMENT OF THE BARGAIN BETWEEN THE PARTIES AND THAT POLYFIRE WOULD NOT HAVE MADE THE SERVICE AVAILABLE WITHOUT THESE LIMITATIONS.

The limitations set forth in this section apply regardless of whether PolyFire knew or should have known of the possibility of such losses. You acknowledge that losses sustained through prediction market trading, smart contract interactions, or cryptocurrency activities are market losses, not losses caused by PolyFire, and are therefore not subject to recovery from PolyFire regardless of the circumstances. PolyFire is not an insurer of your trading activity or the performance of your portfolio.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. To the extent that applicable law prohibits the exclusion or limitation of liability for certain types of damages, PolyFire's liability in such jurisdictions shall be limited to the maximum extent permitted by applicable law. Nothing in this section limits PolyFire's liability for death or personal injury caused by gross negligence or willful misconduct, or for fraud, to the extent such limitations are prohibited by applicable law.

23. Indemnification

You agree to defend, indemnify, and hold harmless PolyFire and its officers, directors, employees, contractors, agents, affiliates, licensors, successors, and assigns (collectively, "PolyFire Indemnitees") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party right, including intellectual property rights, privacy rights, or proprietary rights; (e) any transactions you execute through the Service; (f) your participation in the referral program, including any claims by referred users or regulatory authorities regarding your referral activities; (g) any content or information you provide to PolyFire; or (h) any dispute between you and any third party arising from your use of the Service.

PolyFire reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. In such case, you agree to cooperate with PolyFire's defense of such claim and to not settle any claim without PolyFire's prior written consent. You agree not to settle any indemnified claim without PolyFire's prior written consent if such settlement would impose any obligation or liability on PolyFire or adversely affect PolyFire in any way.

Your indemnification obligations survive termination of these Terms and your cessation of use of the Service. PolyFire will provide prompt notice of any claim for which indemnification is sought, though failure to provide prompt notice shall not relieve your indemnification obligations except to the extent that you are materially prejudiced by such failure.

24. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH POLYFIRE AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF. THIS ARBITRATION PROVISION WAIVES YOUR RIGHT TO A JURY TRIAL.

Before initiating arbitration, you agree to first contact PolyFire via the /support command or @polyfireco on Telegram and describe the nature of your dispute and the relief you are seeking. You and PolyFire agree to attempt to resolve the dispute informally for a period of thirty (30) days following initial notification. If the dispute is not resolved within that period, either party may initiate binding arbitration.

All disputes, claims, or controversies arising out of or relating to these Terms, the Service, or your use of the Service that are not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") pursuant to its Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable, then in effect. The arbitration shall be conducted by a single arbitrator. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

The arbitration shall be conducted virtually or, if an in-person hearing is required, in the state of Wyoming. The arbitrator shall apply Wyoming substantive law and the Federal Arbitration Act. The arbitrator shall have the authority to award any relief that would be available in court, subject to the limitations set forth in Section 22 of these Terms. The arbitrator may not consolidate claims or conduct class arbitration without the consent of all parties.

Notwithstanding the foregoing arbitration requirement, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute. The existence of this arbitration provision shall not preclude either party from seeking such relief.

You may opt out of this arbitration agreement within thirty (30) days of first using the Service by sending written notice to PolyFire via @polyfireco on Telegram stating that you elect to opt out of the arbitration agreement. If you opt out, you and PolyFire agree that disputes shall be resolved in the courts described in Section 26.

25. Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND POLYFIRE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR MULTI-PLAINTIFF PROCEEDING. Neither you nor PolyFire may act as a class representative, private attorney general, or in any other representative capacity, nor participate as a member of a class of claimants, with respect to any dispute subject to arbitration under these Terms.

The arbitrator shall have no authority to consolidate the claims of multiple individuals and shall have no authority to conduct class-wide arbitration, private attorney general arbitration, or representative arbitration. If this class action waiver is deemed unenforceable by a court of competent jurisdiction with respect to a particular claim, then only that claim shall proceed in court, and all other claims shall remain subject to binding individual arbitration.

You acknowledge and agree that this class action waiver is a material term of these Terms and that PolyFire would not have made the Service available to you on the terms offered without this waiver. The waiver of class proceedings shall survive the termination of these Terms.

26. Governing Law

These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Subject to the arbitration agreement in Section 24, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Wyoming for the resolution of any disputes not subject to arbitration. You waive any objection to the laying of venue in such courts, including any objection that such courts are an inconvenient forum. If you opt out of the arbitration agreement or if arbitration is found unenforceable for any reason, disputes shall be resolved exclusively in Wyoming state or federal courts.

PolyFire makes no representation that the Service is appropriate or available for use in any particular location. You access the Service at your own risk and are responsible for compliance with local laws applicable to your use of the Service. The choice of Wyoming law is not intended to create or imply that PolyFire is subject to any particular regulatory regime simply by virtue of being organized or based in Wyoming.

27. Force Majeure

PolyFire shall not be liable for any failure or delay in performance under these Terms to the extent that such failure or delay is caused by circumstances beyond PolyFire's reasonable control, including without limitation: acts of God, natural disasters, pandemic or epidemic, acts of war, terrorism, civil unrest, strikes or labor disputes, government actions or regulations, embargoes, sanctions, blockchain network failures or congestion, smart contract failures or exploits, failures of third-party infrastructure or services (including Telegram, Polygon, cloud providers, or data providers), power outages, internet outages, cyberattacks, ransomware, distributed denial-of-service attacks, or any other cause beyond PolyFire's reasonable control ("Force Majeure Event").

In the event of a Force Majeure Event, PolyFire's obligations under these Terms are suspended for the duration of the event. PolyFire will use commercially reasonable efforts to resume normal operations as soon as reasonably practicable following the cessation of the Force Majeure Event. PolyFire will provide notice to users of a Force Majeure Event affecting the Service through available channels as soon as reasonably practicable. Force Majeure Events do not relieve you of your obligation to pay any fees already accrued prior to the commencement of the Force Majeure Event.

28. Severability

If any provision of these Terms is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or void for any reason, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, severed from these Terms. The invalidity of one or more provisions shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The parties agree that the court or arbitrator shall endeavor to give effect to the parties' intentions as reflected in the invalid provision.

The severability of any provision of these Terms does not affect PolyFire's right to enforce such provision to the maximum extent permitted by applicable law. If the class action waiver in Section 25 is found unenforceable, the arbitration agreement in Section 24 may, at PolyFire's election, be severed from these Terms, and disputes may proceed in court as provided in Section 26.

29. Entire Agreement

These Terms, together with PolyFire's Privacy Policy and any additional terms applicable to specific features of the Service, constitute the entire agreement between you and PolyFire with respect to the Service and supersede all prior and contemporaneous agreements, understandings, negotiations, representations, and warranties between the parties, whether written or oral, relating to the subject matter hereof. No prior or contemporaneous representations or statements by PolyFire shall be binding unless incorporated into these Terms.

You acknowledge that you have not relied on any representation, warranty, or promise made by or on behalf of PolyFire that is not expressly set out in these Terms. If any term of these Terms conflicts with any other PolyFire policy or guideline, these Terms shall control unless the other policy or guideline expressly states otherwise.

30. Assignment

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms to any third party without the prior written consent of PolyFire. Any purported assignment in violation of this restriction shall be null and void. PolyFire may freely assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, without your consent, including in connection with a merger, acquisition, corporate reorganization, change of control, sale of assets, or operation of law. Any permitted assignment by PolyFire shall not reduce your rights under these Terms or PolyFire's obligations to you.

These Terms are personal to you and may not be transferred by operation of law. In the event of your death or incapacity, your rights under these Terms shall not pass to your estate or heirs, except with respect to any funds currently held in your blockchain wallet, which are accessible via the private key independent of these Terms.

31. Waiver

No failure or delay by PolyFire in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege. No waiver by PolyFire of any breach of these Terms by you shall be effective unless in writing and signed by an authorized representative of PolyFire. A written waiver of a particular breach does not constitute a waiver of any future breach of the same or any other provision.

32. Modifications to Terms

PolyFire reserves the right to modify these Terms at any time, for any reason, in its sole discretion. When we make material changes to these Terms, we will update the "Last updated" date at the top of this page and, to the extent practicable, provide notice of the modification through the bot or the PolyFire website. We may, but are not obligated to, provide advance notice of modifications. Some modifications may take effect immediately upon posting, while others may take effect on a stated future date.

Your continued use of the Service after any modification to these Terms constitutes your binding acceptance of the modified Terms. If you disagree with any modification, your sole remedy is to cease using the Service. You are responsible for periodically reviewing these Terms to stay informed of any changes. PolyFire is not responsible for any loss or harm you experience as a result of your failure to review updated Terms.

Modifications to the arbitration provision in Section 24 shall not apply to claims that arose before the effective date of the modification, unless you expressly agree otherwise. For all other modifications, the modified Terms apply prospectively to your use of the Service following the effective date.

33. Modifications to Service

PolyFire reserves the right to modify, add, remove, or discontinue any feature, functionality, or aspect of the Service at any time, with or without notice, and without liability to you. This includes the right to change fee structures (subject to the notice requirements in Section 9), modify the referral program, discontinue copy trading, change the list of available markets or Smart Wallets, change the supported token types, or discontinue the Service entirely. PolyFire may also impose limits on certain features or restrict access to parts or all of the Service without notice or liability.

If PolyFire decides to discontinue the Service in its entirety, we will use commercially reasonable efforts to provide advance notice to allow you sufficient time to withdraw your funds. However, you acknowledge that your blockchain wallet and its contents exist independently on the Polygon blockchain and remain accessible to you via your exported private key regardless of whether PolyFire continues to operate. This is why we so strongly recommend that all users export their private key.

34. Termination and Suspension

PolyFire reserves the right to suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, with or without cause and with or without notice, including but not limited to: (a) your violation or suspected violation of these Terms; (b) your violation or suspected violation of applicable law; (c) your engagement in prohibited conduct as described in Section 17; (d) your abuse or suspected abuse of the referral program; (e) your use of the Service from a sanctioned jurisdiction; (f) PolyFire's receipt of a valid legal order from a government authority; (g) fraudulent or suspicious activity associated with your account; (h) failure to pay any amounts owed to PolyFire; or (i) any other reason PolyFire deems sufficient in its sole discretion.

Suspension or termination may include: blocking your Telegram user ID from accessing the bot, restricting your ability to execute trades or withdrawals, forfeiting accrued but unpaid referral commissions where permitted by applicable law, or any combination of the foregoing. PolyFire is not obligated to provide a reason for any suspension or termination. PolyFire is not liable to you or any third party for any consequences of a suspension or termination, including trading losses arising from your inability to access the Service.

You may terminate your use of the Service at any time by ceasing to use the bot and withdrawing your funds. There are no termination fees. However, termination of your account does not affect any outstanding referral relationships — users you have referred remain referred users, but any ongoing commission obligations will cease upon termination unless PolyFire determines otherwise in its discretion.

35. Effects of Termination

Upon termination of your access to the Service for any reason, your right to use the Service and all licenses granted under these Terms immediately terminate. You must immediately cease all use of the Service. Termination does not affect: (a) your ownership of and access to your blockchain wallet via an exported private key; (b) any on-chain transactions that have already been confirmed; (c) any positions you hold in Polymarket markets (which remain on-chain and resolve according to Polymarket's oracle); (d) any obligations you have incurred prior to termination, including indemnification obligations; or (e) any of PolyFire's rights and remedies that arose prior to termination.

Provisions of these Terms that by their nature should survive termination shall survive, including without limitation: Sections 5, 6, 12, 13, 14, 15, 18, 21, 22, 23, 24, 25, 26, 35, 36, 37, 38, and 39. Termination of these Terms does not affect any right or cause of action either party may have that arose prior to termination.

Following termination, PolyFire may, but is not obligated to, retain your account data for the period required by applicable law and as described in our Privacy Policy. PolyFire may also retain data necessary to enforce our rights, prevent abuse, comply with legal obligations, or assist with investigations.

36. Data and Privacy

PolyFire collects, processes, stores, and uses information about you and your use of the Service as described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy. You should review the Privacy Policy carefully to understand our data practices.

PolyFire stores your encrypted private key in its database using AES-256-GCM encryption. While we employ industry-standard security measures to protect your data, no security system is impenetrable. In the event of a security breach that compromises your encrypted private key or other sensitive data, PolyFire will notify you as required by applicable law and take reasonable steps to mitigate the harm. However, PolyFire cannot guarantee that a breach will not occur and is not liable for losses arising from security breaches despite our commercially reasonable security efforts.

You acknowledge that all blockchain transactions executed through the Service are publicly visible on the Polygon blockchain and are permanently associated with your wallet address. PolyFire has no ability to make blockchain transactions private or remove them from the public record. If you are concerned about the privacy of your on-chain activity, you should take independent steps to protect your identity, such as using a dedicated trading wallet unconnected to your primary wallet.

PolyFire may collect and analyze aggregated, anonymized data about usage patterns to improve the Service. PolyFire may share such aggregated, anonymized data with third parties for business purposes. PolyFire will not sell your personally identifiable information to third parties without your explicit consent, except as required by law or in connection with a merger, acquisition, or sale of assets where user data is a transferred asset, subject to the protections described in the Privacy Policy.

37. Anti-Money Laundering Disclaimer

PolyFire prohibits the use of the Service for money laundering, terrorist financing, or any other financial crime. You represent and warrant that: (a) your funds used through the Service are derived from legitimate sources; (b) your use of the Service does not violate any applicable anti-money laundering ("AML") or counter-terrorism financing ("CTF") laws or regulations; and (c) you will not use the Service to conceal, disguise, or legitimize the proceeds of any criminal activity.

PolyFire is not a regulated financial institution and, at this time, does not implement a formal Know Your Customer ("KYC") program or formal AML compliance program as required of regulated entities. However, PolyFire reserves the right to implement identity verification, transaction monitoring, or other AML/CTF compliance measures at any time without notice, including in response to applicable legal requirements. We may require you to provide identity verification documents before continuing to use the Service.

PolyFire reserves the right to suspend or terminate accounts where we have reason to believe that funds are derived from criminal activity, that the Service is being used to launder money, or that a user is otherwise engaged in financial crime. PolyFire may cooperate with law enforcement investigations and may be required by law to disclose account information, transaction histories, and other data to government authorities without notice to you.

You acknowledge that all blockchain transactions are permanently recorded on the public Polygon blockchain and may be analyzed by law enforcement, regulatory agencies, blockchain analytics firms, or other parties. You acknowledge that the pseudonymous nature of blockchain transactions does not guarantee anonymity, and that your transactions may be traceable to your identity through blockchain analytics or other means.

38. Tax Obligations

You are solely responsible for determining, calculating, reporting, and paying all taxes applicable to your use of the Service, including taxes arising from: (a) trading gains and losses on prediction markets; (b) receipt of referral commissions; (c) cryptocurrency transactions, including swaps and withdrawals; (d) receipt of staking rewards, airdrops, or other cryptocurrency income; and (e) any other taxable event arising from your use of the Service. Tax laws applicable to cryptocurrency and prediction market activities vary significantly by jurisdiction and are evolving rapidly.

PolyFire does not provide tax advice, does not withhold taxes on your behalf (except as may be required by applicable law), and does not issue tax forms, including IRS Form 1099, unless required to do so by applicable law. PolyFire may be required by applicable law to report certain transactions to tax authorities, and you agree to cooperate with PolyFire in fulfilling any such reporting obligations. You agree to hold PolyFire harmless from any liability arising from your failure to meet your tax obligations.

You should consult a qualified tax professional in your jurisdiction before using the Service to understand the full scope of your tax obligations. Prediction market winnings may be treated as gambling income, capital gains, ordinary income, or under other classifications depending on your jurisdiction. The receipt of referral commissions may be treated as self-employment income, business income, or otherwise. Cryptocurrency transactions may trigger taxable events even when you do not receive cash proceeds. These determinations are highly jurisdiction-specific and PolyFire makes no representations regarding them.

39. Sanctions and Export Compliance

The Service is subject to United States export control and sanctions laws, including the Export Administration Regulations ("EAR") and regulations administered by the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"). You represent and warrant that: (a) you are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive U.S. sanctions, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine (collectively, "Sanctioned Territories"); (b) you are not identified on any U.S. government denied party list, including the OFAC Specially Designated Nationals and Blocked Persons List ("SDN List"), the Bureau of Industry and Security ("BIS") Denied Persons List, or any other applicable government denied parties list; and (c) you will not access or use the Service in any Sanctioned Territory or provide access to the Service to any sanctioned person or entity.

PolyFire reserves the right to implement geolocation-based or IP-based blocking measures to restrict access from Sanctioned Territories. Such technical measures are not PolyFire's primary compliance mechanism, and users remain responsible for complying with applicable sanctions laws regardless of whether they are technically able to access the Service. PolyFire may terminate your account without notice if we determine that you are or may be subject to sanctions.

You acknowledge that applicable sanctions lists are updated frequently and that it is your responsibility to ensure that your use of the Service remains compliant with applicable sanctions laws at all times. PolyFire is not responsible for losses arising from the suspension or termination of your account due to sanctions compliance measures. PolyFire may cooperate with OFAC and other government authorities in connection with sanctions investigations and may be required to block, freeze, or report accounts associated with sanctioned parties without notice.

PolyFire provides support exclusively through the following channels. PolyFire does not provide support via telephone, postal mail, or general email. We cannot verify your identity or account through any channel other than the official bot, so please do not share sensitive information through unofficial channels.

Legal notices sent through the /support bot command may not receive a timely response for formal legal matters.

PolyFire will attempt to respond to all legitimate support requests within a commercially reasonable time. However, PolyFire does not guarantee any particular response time and is not liable for losses arising from delays in responding to support requests. PolyFire's support team cannot reverse confirmed blockchain transactions, recover lost private keys, access funds in your wallet, or override the decisions of third-party protocols such as Polymarket. Please do not contact support expecting these outcomes.

PolyFire's official representatives will never ask for your private key, seed phrase, or wallet password under any circumstances. If you receive a communication purporting to be from PolyFire that requests such information, it is a scam. Please report such communications to @polyfireco immediately. PolyFire is not responsible for losses arising from phishing attacks, social engineering, or impersonation scams targeting PolyFire users.

By using the Service, you acknowledge that you have read these Terms of Service in their entirety, that you understand them, and that you agree to be bound by all of their provisions.
